Welcome to RateMySetup ("the Service"), operated via ratemysetup.co.uk. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use RateMySetup. By registering, you confirm that you meet this age requirement. If you are under 18, you confirm that a parent or guardian consents to your use of the Service.

2. Your Account

• You are responsible for keeping your login credentials secure.
• You must not share your account or let anyone else access it.
• You must provide accurate information when creating your account.
• We strongly recommend enabling two-factor authentication for additional security.
• You can delete your account at any time from the Settings page. Deletion is permanent and cannot be undone.

3. User Content

"User Content" means any photos, text, descriptions, comments, ratings, tags, or gear lists you submit to the Service.

• You retain ownership of your User Content.
• By uploading content, you grant RateMySetup a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your content as part of operating the Service (for example, displaying your setup on the browse page or in competition results).
• This licence ends when you delete the content or your account, except where the content has been shared by other users or is retained in moderation records.
• You must not upload content that you do not have the right to share.

4. Prohibited Conduct

You agree not to:

• Upload content that is illegal, sexually explicit, violent, hateful, harassing, or otherwise harmful.
• Upload images that contain personal information of others without their consent.
• Impersonate another person or misrepresent your identity.
• Spam, manipulate ratings, or abuse the voting system.
• Attempt to access other users' accounts or private data.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Circumvent security measures, rate limits, or moderation actions.
• Use the Service for any unlawful purpose.

5. Moderation & Enforcement

We reserve the right to moderate content and enforce these Terms. Our moderation system operates as follows:

• Reports — any user can report a setup, comment, or profile for violating these Terms.
• 1st strike — a warning is issued via email.
• 2nd strike — a 7-day posting restriction is applied (you cannot upload setups or post comments during this period).
• 3rd strike — your account is permanently banned.
• We may remove any content that violates these Terms without prior notice.
• We may skip directly to a ban for severe or repeated violations.
• Moderation decisions are at our sole discretion.

6. Competitions

• RateMySetup runs community competitions where setups are voted on by users.
• Competitions are for entertainment and community engagement purposes.
• We reserve the right to disqualify entries that violate these Terms or are submitted fraudulently.
• Competition rules, categories, and schedules may change at our discretion.

7. Amazon Affiliate Links

RateMySetup is a participant in the Amazon Associates Programme, an affiliate advertising programme designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.co.uk. Gear links on setups may contain affiliate tags. Clicking these links and making purchases may earn us a commission at no extra cost to you.

8. Donations

RateMySetup is not a registered charity. Donations made via the donate page are voluntary contributions to help support the running of the platform. Donations are non-refundable.

9. Intellectual Property

The RateMySetup name, logo, design, and code are our property. You may not copy, modify, or redistribute any part of the Service without our written permission. User Content remains the property of its respective creators as described in Section 3.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for any data loss resulting from your use of the Service.

11. Limitation of Liability

To the maximum extent permitted by law, RateMySetup shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.

12. Third-Party Links & Services

The Service may contain links to third-party websites (including Amazon, Discord, Twitter/X, and TikTok). We are not responsible for the content, privacy practices, or availability of those services. Your use of third-party services is governed by their own terms and policies.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify registered users via email.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
